Foam party terms for 570 Foam Bash
Please review these terms before booking or participating in a 570 Foam Bash event. Our goal is simple: safe setup, clear expectations, and a party everyone can enjoy.
Booking Agreement
The undersigned customer, referred to in these terms as the "Customer," has hired 570 Foam Bash LLC, referred to as "570 Foam Bash," to provide a foam party at the address provided by the Customer, referred to as the "Event." In consideration of the services to be provided by 570 Foam Bash, and in addition to the fee for services to be paid by the Customer, the Customer agrees to the terms below.
By booking, paying a deposit, accepting an invoice, signing an agreement, allowing setup to begin, entering the designated foam area, or allowing guests to participate, the Customer confirms that they have read, understood, and accepted these terms and conditions.
Participation Risks
The Customer and all guests participate in a foam party voluntarily and at their own risk. Foam parties involve wet surfaces, slippery conditions, reduced visibility, active movement, water, electrical equipment, hoses, sound equipment, foam solution, and other conditions that may create risk of injury or property damage.
Although 570 Foam Bash takes precautions intended to make the Event safe and enjoyable, 570 Foam Bash cannot and does not guarantee that accidents, injuries, falls, allergic reactions, property damage, weather-related issues, law enforcement action, or other mishaps will not occur. Serious injury is possible.
If the Customer or any guest has any doubt or concern about safety, health, well-being, clothing, belongings, surfaces, flooring, landscaping, or personal property, that person should not participate and should not enter the premises, designated foam area, or any area where foam, water, or overspray may reach.
Liability Release
To the fullest extent permitted by law, the Customer agrees to release, discharge, defend, indemnify, and forever hold harmless 570 Foam Bash LLC, 570 Foam Bash, and their employees, affiliates, owners, officers, directors, contractors, agents, representatives, successors, and assigns from and against any and all claims, demands, damages, fees, actions, causes of action, liabilities, losses, penalties, citations, fines, costs, and expenses, including attorney's fees, whether in contract or tort, in law or equity, liquidated or unliquidated, that arise out of or relate in any way to the Event.
This release and indemnity includes, without limitation, claims involving personal injury, illness, death, allergic reaction, skin irritation, eye irritation, respiratory issue, slip and fall, property damage, equipment damage, clothing damage, staining, flooring damage, landscaping damage, drainage issues, noise complaints, permit issues, law enforcement action, municipal action, or claims made by any local, county, state, or federal agency.
The Customer accepts responsibility for claims made by the Customer, members of the Customer's family, guests, invitees, licensees, minors, contractors, subcontractors, agents, representatives, neighbors, property owners, tenants, or any other person present at or affected by the Event. This release and indemnity applies whether the claim is alleged to have been caused by the fault, negligence, acts, or omissions of 570 Foam Bash or otherwise, except where prohibited by law.
Host Responsibilities
The Customer is responsible for selecting and approving the Event area and confirming that the area is safe and suitable for foam, water, foot traffic, hoses, cords, vehicles, and equipment. The Customer must obtain permission from the property owner, landlord, venue, HOA, school, municipality, or other authority when applicable.
The Customer agrees to inform all participants, parents, guardians, guests, and attendees of all potential hazards and precautions, including slippery surfaces, water exposure, foam exposure, limited visibility, allergy risks, and property risks. The Customer accepts responsibility for all participants and guests at the Event.
The Customer must provide reasonable access to the setup area, a safe operating space, and any water or power access required for the selected package unless otherwise agreed in writing. The Customer is responsible for keeping the foam area clear of sharp objects, glass, rocks, holes, toys, furniture, electrical items, pets, vehicles, and other hazards.
Foam Party Safety Rules
- All participants should use extreme caution because the ground, flooring, grass, pavement, steps, decks, and other surfaces may become slippery.
- No running, pushing, wrestling, diving, flips, rough play, or unsafe behavior is allowed in or near the foam area.
- Participants should avoid eye contact with foam and should not ingest foam or intentionally inhale foam.
- Participants should remove or secure glasses, watches, jewelry, phones, keys, sharp items, and valuables before entering the foam area.
- Children must be supervised by a responsible adult at all times. 570 Foam Bash does not provide babysitting, lifeguarding, security, medical care, or crowd control services.
- Any participant who feels discomfort, dizziness, breathing difficulty, skin irritation, eye irritation, or any other issue should leave the foam area immediately and rinse with clean water.
Health and Allergies
Although the foam used is considered safe when used as directed, persons with allergies, asthma, breathing issues, skin disorders, sensitive skin, open wounds, eye conditions, immune conditions, or any other medical condition should consult a doctor before entering or being exposed to the foam.
The foam may cause dermatitis, dryness, or irritation in certain individuals, especially if left on the skin for an extended amount of time. After the Event, participants should remove wet clothing, rinse or bathe with clean water, and use moisturizer if needed.
The Customer acknowledges that 570 Foam Bash is not responsible for medical screening, medical advice, first aid, emergency care, or determining whether any person is medically fit to participate.
Foam Output and Conditions
The amount of foam that stays in a designated area can vary greatly depending on temperature, humidity, wind, rain, water hardness, water pressure, floor surface, drainage, slope, number of participants, and participant activity. High temperatures, porous floors, wind, and large numbers of people can result in faster foam dissipation.
570 Foam Bash makes no guarantee regarding the exact amount of foam generated, how high foam will build, how long foam will last, or how foam will behave in any specific environment. Foam output may be adjusted or stopped if 570 Foam Bash believes conditions are unsafe or unsuitable.
Property and Surface Protection
The Customer must protect all floors, surfaces, landscaping, personal property, electronics, furniture, vehicles, pools, drains, doors, windows, and other property. Foam can damage anything that regular water can damage.
Colored or UV foam may stain if not washed thoroughly within 24 hours. Grass, cement, and asphalt are usually suitable, but porous flooring, some tile, natural stone, wood, painted surfaces, sealed surfaces, decks, indoor flooring, and delicate materials may stain, become slippery, warp, discolor, or be damaged.
The Customer is responsible for choosing the area where foam will be blown before booking and before setup. 570 Foam Bash is not responsible for damage, staining, cleanup, drainage issues, or loss caused by the negligence, instructions, location choice, or conduct of the Customer, property owner, venue, attendees, or guests.
Weather and Setup Access
570 Foam Bash may delay, pause, modify, relocate, reschedule, or cancel an Event due to weather, lightning, high winds, unsafe ground conditions, inadequate water or power, blocked access, unsafe behavior, law enforcement direction, permit issues, or any condition that 570 Foam Bash determines may create a safety, property, equipment, or operational risk.
If 570 Foam Bash arrives and cannot safely or reasonably perform because of site conditions, lack of access, lack of required utilities, unsafe behavior, incorrect address, denied permission, or other Customer-controlled issues, the Event may be treated as completed or canceled without refund, at 570 Foam Bash's discretion.
Photos and Video
The Customer agrees that any film, photography, video, audio, social media content, or other media captured by 570 Foam Bash at the Event may become property of 570 Foam Bash and may be used for promotional or commercial purposes without compensation. The Customer is responsible for notifying guests and obtaining any permissions required for minors or attendees when applicable.
If the Customer does not want 570 Foam Bash to capture or use media from the Event, the Customer must provide written notice before the Event begins.
Payments and Cancellations
All payments must be paid in full at the start of the party unless otherwise agreed in writing. Once booked, $50 of the fee is due as a deposit. By accepting these terms and conditions, the Customer authorizes 570 Foam Bash LLC to process the order for a foam party.
If the Customer cancels, the Customer should do so before the day of the party. Deposits are not refunded for Customer cancellations because the date and time were reserved and may not be available for another customer. If 570 Foam Bash cancels for weather or another reason determined by 570 Foam Bash, the deposit will be refunded or the Event may be rescheduled by agreement. No refunds will be made after the party has started.
Customer Authority and Acceptance
The Customer represents that they are at least 18 years old and have authority to enter into this agreement, approve the Event location, and accept these terms on behalf of the household, organization, venue, property owner, guests, and participating minors as applicable.
The Customer certifies that they have read the above terms and conditions, understand them, and agree to be bound by them. If any portion of these terms is found unenforceable, the remaining portions will remain in effect to the fullest extent permitted by law.
